This document constitutes a legally binding agreement between you ("User", "You") and GreenEars Audio LLC ("GreenEars", "we", "us", "our"), a Utah limited liability company. It describes how GreenEars handles claims of copyright and trademark infringement under the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. ss. 512.

1. INTELLECTUAL PROPERTY RESPECT

2. DESIGNATED AGENT

2.1 GreenEars' DMCA Designated Agent for receiving notifications of claimed infringement under 17 U.S.C. ss. 512(c)(2):

3. NOTICE OF CLAIMED INFRINGEMENT (DMCA NOTICE)

3.1 To submit a DMCA Notice, send a written communication to the Designated Agent (email or postal). To be effective under 17 U.S.C. ss. 512(c)(3), your notice must include substantially the following:

3.1.1 a physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;

3.1.2 identification of the copyrighted work claimed to have been infringed (or, if multiple works at a single online site are covered by a single notification, a representative list of such works);

3.1.3 identification of the material claimed to be infringing that is to be removed or access to which is to be disabled, with information reasonably sufficient to permit us to locate it (such as a URL);

3.1.4 your contact information:

name, address, telephone number, and email address;

3.1.6 a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3.2 We may forward the notice (including the complainant's identity) to the alleged infringer.

4. COUNTER-NOTIFICATION

4.1 If material you posted was removed in response to a DMCA Notice and you believe the removal was in error or misidentification, you may submit a Counter-Notification under 17 U.S.C. ss. 512(g)(3) containing substantially:

4.1.1 your physical or electronic signature;

4.1.2 identification of the material that was removed or disabled and the location at which it appeared before removal;

4.1.3 a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;

4.1.4 your name, address, and telephone number; and

4.2 We may forward the Counter-Notification to the original complainant. If the complainant does not file suit within 10-14 business days, we may restore the material.

5. REPEAT INFRINGER POLICY

5.1 In accordance with 17 U.S.C. ss. 512(i), it is GreenEars' policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

7. FALSE CLAIMS WARNING

7.1 Under 17 U.S.C. ss. 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages including costs and attorneys' fees.
