This document constitutes a legally binding agreement between you ("User", "You") and GreenEars Audio LLC ("GreenEars", "we", "us", "our"), a Utah limited liability company. It describes how you may and may not use the GreenEars website, plugins, and other services.

1. WEBSITE - PROHIBITED CONDUCT

1.1 You may not, and may not permit any third party to:

1.1.1 harass, threaten, defame, or impersonate any person on the website or any community channel GreenEars operates;

1.1.2 upload or transmit unlawful, infringing, defamatory, obscene, or harmful content;

1.1.3 upload or transmit malware, viruses, worms, trojans, or other malicious code;

1.1.4 scrape, crawl with automated tools, mirror, frame, or systematically download the website beyond what is permitted by robots.txt and beyond non-abusive search-engine indexing;

1.1.5 use the website to train artificial intelligence or machine-learning systems;

1.1.6 attempt to gain unauthorized access to any account, server, or system;

1.1.7 probe, scan, or test the vulnerability of the Services except through a coordinated good-faith disclosure to security@greenearsaudio.com (which we welcome);

1.1.8 bypass or attempt to bypass rate limits, authentication, license validation, or other technical protections; or

1.1.9 use the Services in violation of any law.

2. PLUGINS - PROHIBITED CONDUCT

2.1 You may not, and may not permit any third party to:

2.1.1 reverse engineer, decompile, or disassemble the plugin except as permitted under Section 4.1.3 of the EULA (interoperability under EU Directive 2009/24/EC Article 6 or equivalent law);

2.1.2 use the plugin, its UI, its audio output (in isolation as processing of test signals, sweeps, impulses, noise, or other non-creative reference material where the plugin's characteristic sound is the subject of the recording), its parameter behavior, or any derived artifact to develop a competing audio plugin or audio processing product;

2.1.3 use the plugin or any of its outputs, behaviors, or internals as training data, fine-tuning data, evaluation data, RAG corpus, or any other input to any AI or machine-learning system, as set out in Section 4.1.7 of the EULA (this is distinct from using your own music or audio works that happen to be processed by the plugin, which remain yours to use as you wish);

2.1.4 pirate, crack, share, leak, post, sell, lend, lease, or otherwise distribute the plugin, its installer, or your license file (license.mb) or license JWT. We periodically scan public hosting services for leaked GreenEars license JWTs and may revoke compromised licenses;

2.1.5 use cracked or unauthorized copies of the plugin;

2.1.6 use the plugin in any high-risk application as described in Section 4.1.9 of the EULA (life support, nuclear, aviation, weapons, etc.);

2.1.7 distribute sample packs, sound libraries, "drum kits", "impulse responses", or similar collections whose value depends on capturing or replicating the GreenEars plugin's characteristic sound, marketed as such, unless we have given express written permission. Music or content that incidentally uses the plugin is fine; commercial products designed to substitute for or mimic the plugin are not;

2.1.8 distribute any output of the plugin specifically marketed or labeled as an AI/ML training dataset.

3. ENFORCEMENT

3.1 Violations may result in any combination of:

a warning, suspension of access, termination of your account, revocation of licenses (without refund where the breach is material), referral to law enforcement, and civil legal action including injunctive relief and damages.

3.2 We may preserve and disclose information to law enforcement where lawful and appropriate.
